Law Of Criminal Procedure II (Including Juvenile Justice Act)

Subject shall be taught by incorporating Code of Criminal Procedure, 1973 (CrPC), Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), relevant laws and amendments, case laws and the recent developments.


Unit I

Complaints to Magistrates: Procedure, requirements and initiation - Commencement of Proceedings: Steps involved in initiating criminal proceedings - Role of Magistrates: Powers and responsibilities in pre-trial and trial phases. Charges - Framing of charges and joinder of charges - Rules and provisions under BNSS for effective charge management.


Unit II

Common Features of Trials: Principles and legal provisions for fair trial. Inquiry and Trial: Definitions, distinctions and procedural requirements. Evidence Collection - Mode of taking and recording evidence during inquiries and trials - Use of commission for evidence collection. Types of Trials - Summons cases, warrant cases and summary trials - Disposal of cases without full trial and alternative resolutions.


Unit III

Compounding and Non-Compounding of Offenses: Legal distinctions and procedures - Trial of Persons of Unsound Mind: Legal considerations and procedural adaptations. Offenses Affecting Administration of Justice – Bail - Regular and anticipatory bail requirements, provisions and recent developments - Property Disposal: Guidelines for disposal and handling of property involved in cases. Irregular Proceedings: Identification, impact and rectification.


Unit IV

Transfer of Cases: Provisions for case transfers within jurisdictions. Judgment: Requirements for drafting and delivering judgments. Specific provisions for death sentence confirmation. Appeals and Revisions: Processes and conditions for appeals, revisions and reference. Execution of Sentences: Procedures for execution, commutation and modification of sentences.


Unit V

Juvenile Justice Act: Scope, objectives and recent amendments - Juvenile offenders vs. neglected juveniles - Juvenile Rehabilitation and Protection: Legal approaches to prevention, rehabilitation and reintegration - Procedures in juvenile cases: detention, adjudication and post-trial care.
