 Drafting, Pleading and Conveyancing

Subject shall be taught by incorporating the recent developments.


Outline of the Course

a. Drafting – General principles of drafting and relevant substantive rules shall be taught.

b. Pleading

  1. Civil – Plaint, Written Statement, Interlocutory Application, Original Petition, Affidavit, Execution Petition, Memorandum of Appeal and Revision etc.

  2. Criminal – Complaint, Criminal Miscellaneous Petition, Bail Application, Memorandum of Appeal and Revision etc.

  3. Drafting Petition under Articles 226 and 32 of the Constitution of India and Public Interest Litigation Petition.

c. Conveyancing – Sale Deed, Mortgage Deed, Lease Deed, Gift Deed, Promissory Note, Power of Attorney, Will and Trust Deed etc.


Course Methodology

  • The course will be taught through class instruction and simulation exercises, preferably with the assistance of practising lawyers/retired judges.

  • Apart from teaching the relevant provisions of law, the course will include not less than 15 practical exercises in drafting (45 marks, 3 marks each) and 15 exercises in conveyancing (45 marks, 3 marks each).

  • The remaining 10 marks will be given for viva-voce, internally conducted by a board comprising a practising lawyer and two law faculty members.

  • Students must maintain a record of the practical exercises.


Examination and Attendance Requirements

  • Students shall not be admitted for viva voce examination without the completed records signed by the teacher in charge and head of the institution.

  • A minimum of 75% attendance and 50% marks in practical training of a semester is required to register for the semester examination.

  • A student who fails to secure 50% marks (excluding viva voce) or does not complete all components of the practical paper must repeat the paper with a junior batch.

  • A student who completes all components but fails or misses the viva voce may attend it later as a supplementary candidate with a junior batch.
