Outline Of The Course

  1. Negotiation Skills – Learned Through Simulated Programmes.

  2. Conciliation Skills – Practical Understanding And Application.

  3. Arbitration Law And Practice – Including International Arbitration, Arbitration Rules, And Varieties Of ADR Systems: Tribunals, Ombudsman, Arbitration, Conciliation, Negotiation, And Mediation.

  4. Arbitral Awards – Making Of Awards, Form And Contents.

  5. Access To Justice Movement In India – Growing Focus On ADR Systems – Equal Justice For All – Legal Aid Clinics – Lok Adalats As A Mechanism For Dispute Resolution Through Conciliation And Mediation – Legal Services Authority Act – Powers And Awards Of Lok Adalats – Neethi Mela – Gram Nyayalaya Under Decentralised Local Government Bodies.

Course Delivery

The course shall be conducted preferably by senior legal practitioners and academicians through simulation exercises and case studies. Students must maintain a record of all practical work, exercises, and assignments.

Internal Evaluation (100 Marks)

  • 25 Marks – Internal Viva Voce (Conducted By A Board Consisting Of One Practising Lawyer And Two Law Faculty Members).

Distribution Of Marks

  1. Effective Participation In Two Lok Adalats – 10 Marks

  2. Test Paper Based On Arbitration Law – 15 Marks

  3. Test Paper On Legal Services Authority Act – 15 Marks

  4. Mediation/Arbitration/Conciliation Proceeding (Group Presentation Based On Problem Given By Faculty) – 15 Marks

  5. Practical Record – 20 Marks

  6. Viva Voce – 25 Marks

Attendance & Performance Requirements

  • Minimum 75% attendance and 50% marks in the practical training component of a semester are required to register for the semester examination.

Repeat/Improvement Rules

  • Students who fail to secure 50% marks (excluding viva voce) or fail to complete required practical components must repeat the paper with a junior batch. They must also secure 50% marks in viva voce.

  • Students who complete all practical components except viva voce may appear for the viva as a supplementary candidate along with a junior batch.
